TERMS & CONDITIONS

PLEASE READ THIS NOTICE IN ITS ENTIRETY. IT CONSTITUTES PART OF YOUR BOOKING CONTRACT FOR YOUR TRIP AND ANY RELATED SERVICES. PLEASE CALL US IMMEDIATELY IF YOU HAVE ANY QUESTIONS.

The lead reservation passenger will be the only recipient of this booking receipt and terms and conditions. It is the sole responsibility of the lead passenger to inform all other parties traveling of the contents of these terms and conditions. The lead passenger, by accepting this receipt and making payment to Travel with Sparkle and/or its suppliers, acknowledges that they have been advised of, reviewed, and hereby accept these terms and conditions and contract for all travel related services.

Travel with Sparkle acts only as an independent agent for suppliers in selling travel related services, or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). This travel agency, therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to you or your travel companions or group members. Unless the term “guaranteed” is specifically stated in writing on your ticket, invoice, or reservation itinerary, we do not guarantee any of such suppliers’ rates, bookings, reservations, connections, scheduling, or handling of personal effects. This travel agency shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social, or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent’s control. Please note that Travel with Sparkle has an allegiance to their clients and not any particular vendor. We quote the trip which we feel will best suited to our client’s preferences, budget, and lifestyle. That being said, we do have preferred vendors who we know offer an excellent experience for our travelers. Rates are subject to change without notice until a deposit is made on reservation for rates to be locked in.

Valid US Passport BOOKS are required for all travelers for international air travel, regardless of age, including infants. Traveler assumes complete and full responsibility for, and hereby releases this travel agency from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel.
Traveler assumes full responsibility for obtaining these documents prior to dates of travel. Traveler understands that for a passport to be considered valid it must have 6 months validity remaining on it after projected travel return date.

Travelers also are responsible to be aware if any past criminal activity will impede them boarding an airplane or leaving the United States, which may include, but not limited to unpaid federal loans, declared incompetence, owed large sum of child support, convicted drug trafficking, under federal arrest or subpoena, forbidden by court order, parole, or probation. Canada will not allow entrance if you have ever had a drunken driving conviction. Travelers are recommended to contact their attorney for legal advice should any of these apply to them. By embarking upon his/her travel, the travelers voluntarily assume all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of such risks, and is advised to obtain appropriate insurance coverage against them. Travel with Sparkle does have a vendor who can assist with passport expediting should this service be necessary to complete travel. It is also the traveler’s responsibility to contact their cell phone provider and determine if their plan allows for use outside the US and if so what additional fees apply. It is important to note that if you continue to use your cell/data package while outside the US without adding an international plan, you may incur huge charges for phone and data plan usage outside the US.

It should be noted that children under age 18 and not traveling with both parents or legal guardians may need to present a notarized letter from the absent or non-custodial parent/guardian granting permission for the child to travel outside the United States and provide emergency medical care if necessary. This would apply to grandparents, only one parent traveling, or a divorced parent traveling. Travelers should confer with their attorney to get the correct paperwork in order, or you can find information here: https://www.dhs.gov/how-do-i/travel-overseas

Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above, and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.

Please be advised that air schedules are subject to change at any time prior to travel. Travel with Sparkle accepts no responsibility for air schedule changes, delays or cancellations by any air carrier. Each airline has its own baggage policies and associated fees, it is the sole responsibility of the traveler to confirm with the airline in advance of travel to determine the airline’s baggage policy and any associated fees which are subject to change at any time.

GROUP TRIPS

Travel with Sparkle reserves the right to change tour days or modify the itinerary as needed for Travel with Sparkle group trips.

INSURANCE

Travel with Sparkle sells travel insurance and has provided you detailed information and the opportunity to purchase travel insurance. Many insurance companies require the policy to be purchased and written within a certain timeframe in order to cover things such as pre-existing medical conditions and supplier default. Travel with Sparkle has informed you of this deadline, and highly recommends the purchase of travel insurance to protect your vacation investment. If charges for travel insurance are not listed on your booking statement, you have not paid for insurance within the required timeframe or an insurance policy number is not noted on your final invoice, you have elected to DECLINE Travel Insurance even if you initially checked “accept” on your original invoice. Insurance claim approval is determined by the travel insurance company, and Travel with Sparkle accepts absolutely no responsibility for any denied claims. The purchase of travel insurance to cover your vacation investment is HIGHLY RECOMMENDED for unexpected circumstances that neither the travel agent nor the client can control. It is to be noted that if you do not add travel insurance, your entire trip investment may be at risk. It is also important to note that your personal US medical coverage may not cover you outside the US and each traveler should consult their benefits department for full disclosure of those details.

SPECIAL REQUESTS

Special Requests, (i.e. room views, location, bedding preference, adjoining rooms, seat requests, etc.) cannot be guaranteed by the travel agency/tour operator/airline. While every attempt will be made to accommodate such special requests, the travel agency/tour operator/airline will not be held responsible if such requests cannot be fulfilled. Airline seat requests also cannot be guaranteed even if we note preferences. If a schedule change occurs, it is possible to be moved to a different flight and existing seat assignments may no longer be honored. The travel agency does not have control over the airline nor their seating policies.

PAYMENTS

Payments by credit or debit card are preferred, and by authorizing charges to your card you expressly waive the right to chargebacks as a means to mediate disputes.

Please note that checks are accepted for final payments (within 4 weeks of final payment date) and for initial deposits or airline only tickets. These must be made by credit or debit card only. Bounced checks are subject to a $35 returned check fee, and future payments by check will no longer be accepted. If a credit card is declined, agent will attempt to contact client to remedy the situation. It is important to note that the package price may increase while the details are trying to be corrected in the matter of a credit card decline.

CLIENTS SHOULD NOTE THAT EVEN THOUGH THEY HAVE PAID FOR A VACATION PACKAGE OR SEGMENTS IN ADVANCE, HOTELIERS, AIRLINES, RENTAL CAR COMPANIES AND OTHER VENDORS WILL ASK FOR A CREDIT CARD TO BE USED DURING TRAVEL FOR INCIDENTAL CHARGES, BAGGAGES FEES, RENTAL CAR GUARANTEE, ETC. NEVER TRAVEL WITHOUT A CREDIT CARD WHICH CAN BE USED FOR THESE PURPOSES! IF YOU ARE USING A DEBIT CARD FOR DURING TRAVEL CHARGES, YOU SHOULD EXPECT THAT POSSIBLE HOLDS CAN BE PLACED ON YOUR ACCOUNT FOR SEVERAL DAYS AND THAT MIGHT AFFECT YOUR SPENDING CASH.

Always check with your bank to see if your card incurs foreign transaction fees if you plan to travel outside the US. Monthly payments are required on all group trips to keep your reservation current.

CANCELLATIONS, CHANGES & REFUNDS

Once payment is applied to a booking, cancellation/change penalties will apply. Cancellation policies vary from supplier to supplier. Cancellation requests MUST BE RECEIVED IN WRITING prior to your departure date, and you must receive a written reply from us confirming cancellation has been made. No refund is made for unused travel services or any portion thereof, nor is the price or value of unused travel services exchangeable for alternative arrangements. Changes to the current booking are subject to the terms and conditions of the tour operator/airline and may result in penalties or change fees.

Due to strict contractual obligations, any and all payments on customized group trips are non-refundable non-transferable to another trip. 

PHOTOGRAPHY & VIDEOGRAPHY

Travel with Sparkle reserves the right to use any photograph/video taken at any event or during any travel activity, without the express written permission of those included within the photograph/video. Travel with Sparkle may use the photograph/video in publications or other media material produced, used or contracted by Travel with Sparkle, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.

AIRPORT CHECK IN & FLIGHT RECONFIRMATION

All passengers should arrive at the airport at least 2 (or 3 for international) hours prior to flight departure, view documents for definite recommendation. Charter flights may have different requirements than commercial flights.

 

Travel with Sparkle will make every attempt to assign seats in advance, however if we are unable to assign seats on your flight for any reason, seats will be assigned upon check-in at the airport and are on a first come, first served basis. While seat assignments are made by the airline, we are unable to guarantee that clients will be seated with their traveling companions. For security reasons, all passengers must be present identification for check-in. You will not be allowed to board, nor will you be entitled to a refund, if you have not checked in by the required time. Please ensure you contact your airline at least 24 hours prior to departure and on the day of departure, as it is your responsibility to reconfirm all your flight details before departure. A customer’s failure to contact the airline in regards to reconfirming the airline times and details may result in a flight being missed.

Travel with Sparkle does not accept legal responsibility or liability if any customer misses a flight due to a failure to reconfirm flight times as advised, or to other circumstances beyond our control. If our agency is aware of any schedule changes in advance of your departure, every effort will be made to advise you directly. Clients should understand that being a no show for a flight, may result in the other leg of your flight being cancelled by the airline without notice. ALL airlines charge baggage fees and you should visit the airline website to determine what charges are applicable to your flight and destination. Some seats assignments also have a service fee associated and all seats booked may not be upgradeable.

Again, client has responsibility to visit airline’s website or contact customer service with said airline to determine exact parameters as applicable to your ticket.

HONEYMOONERS & ANNIVERSARY TRAVELERS

You MUST bring a copy of your marriage certificate (or wedding invitation) to qualify for any complimentary honeymoon/anniversary packages offered by the resort. A photo copy is recommended. Failure to have such proof of marriage may result in the resort denying these complimentary privileges (if applicable). Please notify your Travel with Sparkle advisor if you are celebrating a Honeymoon or Anniversary so that they can annotate this in your reservation. Typically resort will honor these packages up to 30 days before or after your honeymoon/anniversary date.

INSECTICIDE DISCLOSURE

The U.S. Department of Transportation (DOT) requires that travel agents refer consumers to a page on the Department’s website that lists countries that require airlines to treat passenger cabins with insecticide. The DOT requirement applies only to airline travel to a country listed on that website. MODIFICATION OF TERMS AND CONDITIONS

The Terms and Conditions may be amended or modified by Travel with Sparkle at any time without notice. It is therefore essential that you consult the Terms and Conditions prior to making each and every booking. Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with Travel with Sparkle. Without this acceptance any booking is subject to cancellation at any time. The failure of Travel with Sparkle to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. Travel with Sparkle does not guarantee it will take action against all breaches of this these Terms and Conditions.

SEVERABILITY

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
